User Agreement

1. Acceptance of Terms

By selling your electronic devices to Sell Your Tech Today ("Company," "we," "us," or "our"), you ("Seller," "you," or "your") agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not proceed with the sale of your device(s).

2. Services Provided

We operate an electronics buyback service located at 2612 S Shepherd Dr, Houston, TX 77098. We purchase used electronic devices including but not limited to:

• Smartphones (iPhone, Android, etc.)
• Tablets and iPads
• Laptops and MacBooks
• Smartwatches and wearables
• Gaming consoles
• Other consumer electronics

3. Device Sale Terms

3.1 Ownership

You represent and warrant that you are the legal owner of the device(s) being sold and have the right to sell them. The device must not be stolen, lost, or subject to any liens or encumbrances.

3.2 Device Condition

You agree to accurately represent the condition of your device. Our final offer is based on physical inspection and may differ from initial quotes if the actual condition varies from your description.

3.3 Data Responsibility

You are solely responsible for backing up and removing all personal data from your device before sale. We are not responsible for any data loss. While we take measures to erase devices, we recommend you perform a factory reset and remove all accounts prior to sale.

3.4 Activation Locks

Devices must be free from activation locks (Find My iPhone, Google FRP, etc.). We cannot purchase locked devices. You must disable all security features and sign out of all accounts.

4. Payment Terms

Payment is made immediately upon acceptance of our offer and completion of the transaction. Payment methods include:

• Cash
• Check
• Bank transfer
• Digital payment (Venmo, Zelle)

All sales are final. Once payment is accepted, the transaction cannot be reversed.

5. Limitation of Liability

To the maximum extent permitted by Texas law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your sale of devices to us. Our total liability shall not exceed the amount paid to you for your device(s).

6. Indemnification

You agree to indemnify and hold harmless Sell Your Tech Today, its officers, employees, and agents from any claims, damages, or expenses arising from your breach of these terms or your sale of devices that you do not legally own.

7. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising under these terms shall be brought exclusively in the courts of Harris County, Texas.

8. Dispute Resolution

In the event of any dispute arising from these terms, the parties agree to first attempt to resolve the matter through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Houston, Texas, in accordance with Texas law.

9. Privacy and Data Protection

We respect your privacy and handle your personal information in accordance with applicable Texas and federal privacy laws. We collect only necessary information for the transaction and do not sell or share your personal data with third parties except as required by law.

10. Prohibited Activities

You agree not to:

• Sell stolen or illegally obtained devices
• Misrepresent the condition or ownership of devices
• Provide false identification or information
• Engage in fraudulent activities

11. Modifications to Agreement

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting. Your continued use of our services after changes constitutes acceptance of the modified terms.

12. Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid under Texas law, such provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms and Conditions constitute the entire agreement between you and Sell Your Tech Today regarding the sale of your electronic devices and supersede all prior agreements and understandings.
